Terms & Conditions of Sale

These Terms & Conditions of Sale apply to all purchases made from Four Seasons Nursery (NSW) Pty Ltd trading as Four Seasons Nursery & Garden Centre (“Four Seasons”, “we”, “us”, or “our”), whether purchased in-store, online, by phone, or via email.

By purchasing goods or services from us, you agree to these terms.

1. General

We reserve the right to update or amend these Terms & Conditions at any time without prior notice. The latest version will always be available on our website.

Nothing in these terms excludes or limits your rights under the Australian Consumer Law.

2. Product Information

We make every effort to ensure product descriptions, specifications, dimensions, pricing, and images are accurate.

However, occasional errors, omissions, or inaccuracies may occur.

Many of our products are natural or handmade and may vary between batches, including:

  • Plants

  • Pots

  • Natural stone

  • Pebbles

  • Timber

  • Mulch

  • Soil

  • Water features

  • Decorative products

Variations in colour, shape, texture, finish, grain, size, and appearance are considered normal and do not constitute faults.

3. Pricing

All prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated.

Prices may change without notice.

Despite our best efforts, pricing errors may occasionally occur. If a product is listed at an incorrect price, we reserve the right to:

  • Cancel the order

  • Refund payment

  • Offer the product at the correct price

If this occurs after an order is placed, we will contact you as soon as possible.

4. Stock Availability

Stock levels shown online or quoted by staff are indicative only and are not guaranteed until payment has been received and stock is allocated.

Stock may become unavailable due to:

  • Supplier shortages

  • Stock discrepancies

  • Damage

  • Seasonal availability

  • High demand

If a product becomes unavailable after purchase, we may offer:

  • A substitute product

  • Store credit

  • A full refund

5. Orders

Orders may be placed:

  • In-store

  • Online

  • By phone

  • By email

We reserve the right to refuse, limit, or cancel any order at our discretion, including where:

  • Payment cannot be processed

  • Stock is unavailable

  • Pricing errors occur

  • Fraudulent activity is suspected

Ownership of goods remains with Four Seasons until full payment has been received.

6. Payment

Payment must be received in full prior to collection or delivery unless otherwise agreed in writing.

Accepted payment methods may include:

  • Cash

  • EFTPOS

  • Credit card

  • Bank transfer

  • Other approved payment methods

Credit card surcharges or payment processing fees may apply.

7. Delivery

Delivery timeframes are estimates only and are not guaranteed.

Delays may occur due to:

  • Weather

  • Traffic

  • Supplier delays

  • Vehicle breakdown

  • Operational requirements

  • Circumstances beyond our control

Customers are responsible for ensuring:

  • Delivery details are accurate

  • Site access is safe and suitable

  • Delivery instructions are clear

Unless otherwise agreed, deliveries are made to a reasonably accessible location as determined by the driver.

Additional charges may apply where deliveries involve:

  • Difficult access

  • Waiting time

  • Re-delivery

  • Crane lifts

  • Hand unloading

  • Stairs or complex access

  • Special handling requirements

8. Click & Collect / Collection

Customers collecting goods must ensure their vehicle is suitable and that goods can be safely restrained during transport.

We reserve the right to refuse loading if staff believe:

  • The vehicle is unsuitable

  • The load is unsafe

  • Transport would breach safety requirements

Risk in goods transfers to the customer upon collection.

9. Special Orders

Special order, custom-made, made-to-order, or supplier-ordered products may require a deposit or full payment.

Once confirmed with a supplier or manufacturer, special orders generally cannot be:

  • Cancelled

  • Changed

  • Refunded

Lead times are estimates only and may vary due to manufacturing or freight delays.

Supplier delays outside our control do not entitle cancellation unless otherwise agreed.

10. Returns & Refunds

Returns and refunds are governed by our Refund & Returns Policy.

Change-of-mind returns may be accepted at our discretion provided goods are:

  • Unused

  • In original condition

  • In saleable condition

  • Returned with proof of purchase

Certain goods may not be eligible for return, including:

  • Special orders

  • Perishable goods

  • Clearance items

  • Damaged goods caused after purchase

Nothing in these terms excludes rights under Australian Consumer Law.

11. Plants and Living Products

Plants are living products and naturally vary in:

  • Size

  • Shape

  • Colour

  • Growth rate

  • Seasonal appearance

Plant health after purchase depends on factors beyond our control, including:

  • Watering

  • Drainage

  • Soil quality

  • Sunlight

  • Weather

  • Pest and disease pressure

  • General care

We cannot guarantee ongoing plant health once products leave our premises.

12. Bulk Materials and Natural Products

Coverage guides, volumes, weights, and bulking factors for bulk materials are estimates only.

This includes products such as:

  • Soil

  • Mulch

  • Sand

  • Gravel

  • Decorative stone

  • Road base

Final volume may vary due to:

  • Moisture content

  • Compaction

  • Settling during transport

  • Storage conditions

  • Product composition

Online calculators and guides are provided as estimates only.

12.1 Website Images and Colour Representation

We aim to display product colours, finishes, and textures as accurately as possible.

Actual product appearance may vary due to:

  • Screen settings

  • Device displays

  • Photography lighting

  • Manufacturing variation

  • Batch differences

  • Natural material variation

Colours and finishes shown online are a guide only.

Where colour accuracy is important, we recommend viewing the product in person before purchase.

12.2 Plant Images and Size Representation

Images of plants on our website, advertisements, and social media are indicative only.

Plants may differ from images depending on:

  • Season

  • Growth stage

  • Availability

  • Pruning

  • Current nursery conditions

Plant heights, widths, pot sizes, and maturity estimates are approximate unless otherwise stated.

Flowering, fruiting, foliage density, and colour may vary significantly throughout the year.

13. Limitation of Liability

To the maximum extent permitted by law, Four Seasons is not liable for indirect, incidental, or consequential loss arising from the supply or use of products.

Where liability cannot be excluded by law, our liability is limited to one or more of the following at our discretion:

  • Replacement of goods

  • Repair of goods

  • Re-supply of services

  • Refund of purchase price

14. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies you may have under Australian law.
